摘　　要：专利钓饵已经进驻中国,对我国的专利制度提出了严峻的挑战。在回顾相关文献的基础上,探讨了专利钓饵的制度成因,分析了专利钓饵的影响以及美国法院、企业的防范措施。在此基础上,研究了我国专利制度中可能被专利钓饵利用的"漏洞",并结合我国专利制度的特点,参考国外对专利钓饵的防范措施,提出了对我国企业、政府防范专利钓饵的诉讼建议。The patent trolls have entered into China and posed a severe challenge on China＇s patent system.The paper explored the institutional reasons of patent trolls’forming,analyzed the impact of patent trolls and the countermeasures which United States＇ courts and enterprises has adopted based on reviewing the relevant literatures.Then,the paper studied the ＇loopholes＇ of China＇s patent system which may be used by patent trolls,and with combining the characteristics of China＇s patent system and making reference for countermeasures that the foreign country has adopted,the paper provided recommendations for China＇s enterprises and government to avoid the risk of litigation and respond to trolls’litigation attacks effectively
