摘　　要：目的帮助食品药品监管执法人员学习、理解《药品和医疗器械行政处罚裁量适用规则》(以下简称《适用规则》),并在行政执法实践中遵照执行。方法针对该《适用规则》出台的背景、适用范围、体系结构和主要内容等进行详细分析、解读。结果与结论《适用规则》的实施,对我国药品和医疗器械行政处罚裁量提供了规范,对提高全系统执法人员的素质和执法水平具有重要意义。Objective To help the food and drug administrative law enforcement personnel to learn,understand the Applicable Rules on Drugs and Medical Devices Administrative Penalty Discretion（hereinafter referred to Applicable Rules） and comply with it in the practice of administrative law enforcement.Methods The Applicative Rules were analyzed and interpreted in details on aspects of the background,applicable scope,systematic structure and main content and so on.Results and Conclusion The implementation of the Applicative Rules provides standards for drugs and medical devices administrative penalty discretion and has important significance for improving quality and law enforcement level of the law enforcement personnel in the whole food and drug supervision system.
