摘 要:当前,民间金融急速膨胀,但民间金融组织游离于监管之外,相关法律对民间融资的管理主体没有明确规定,更没有针对为民间融资设立的系统而完善的监管体系,极易发生风险或纠纷,因此,加强对民间融资的监管与疏导成为当务之急。文章在分析当前浙江民间融资监管困境的基础上,提出其规范化的路径应是构建以政府监管为主导、以企业自我约束为关键、以行业自律为加强的三级监管机制。At present, the private finance is rapidly expanding, but the private financial organizations are drifting outside regulatory, relevant law does not expressly require the management body of the private financing, and comprehensive regulatory system for private financing has not been established, it could easily occur the highly risk or disputes. Therefore, it becomes imperative to strengthen regulation and dredge of private financing. In this paper, based on the analysis of the current regulatory predicament of Zhejiang private financing, it puts forward that the three regulatory mechanism of private financing should be built, which is led by governmental supervision, and self-regulation of the enterprises plays the most critical role in and strengthened by industry self-regulation.
