对“赌球”的法律规制研究

摘　　要：能控制球的人员赌球和赌庄控制球,是典型的赌博诈骗。在该类案件中,行为人赌球的目的,已不再是利用比赛的偶然性获取营利,而是想通过改变赌局偶然性的方式直接骗取他人财物;行为人主要侵犯的不是赌博罪所保护的社会管理秩序法益,也不是"对非国家工作人员行贿罪"所保护的对公司企业的管理秩序法益,而是刑法分则第五章所保护的他人财产法益;同时,该类案件符合诈骗罪的犯罪构成,应当以诈骗罪定性处理。案件中的行贿、受贿,不过是行为人实施诈骗的手段行为或内部分赃行为,一般不需单独评价。Football gambling controlled by game handling persons or gambling companies is a typical gambling fraud. In such case, the feasors don＇t intend to win by chance, but to defraud property by changing the game result. However, the feasors neither obstruct the administration of public order which is protected by Crime of Gambling, nor disrupt the order of administration of companies and enterprises which is protected by Crime of Bribery to Non-government Employees. What they violate is the others property protected in Chapter V of Specific Provisions of Criminal Law of China. Therefore, such case constitutes Crime of Fraud. Bribery and acceptance of bribes in such case are only deceptive means or division of spoils among the feasors so that it is un- necessary to consider them as separate crimes.
