摘 要:小产权房问题的本质是产权制度问题,即经济意义上的产权和法律意义上的产权相互分离,经济意义上的产权没有被正式的法律制度承认和赋权。从产权经济学的理论视角来看,要解决小产权房的问题就需要通过分解和组合土地与房屋的所有权及使用权等,同时引入"规划指标权",以此来扩大产权主体的范围,增加产权的权利内涵和创新产权规则,最终形成多元的组合式房屋产权格局。The essence of the houses with limited property rights is an issue of the property rights system, namely, the economic property rights are separated from the legal property rights, thus the economic property rights are not officially admitted and empowered by the formal legal system. From the perspective of the theory of property right economics, in order to solve the problem of houses with limited property rights, it is necessary to decompose and combine the property right and the right of use of land and housing, introduce the right of planning-index, expand the scope of the property domain, increase the connotation of the property right and the rules of the innovative proper- ty right, so as to form a multiplex combined system of housing rights.
