论海洋防务安全战略的法律构建

摘　　要：未来制定海洋防务安全战略必须由法律构建提供支持和保障。从海洋防务安全战略的目标、方针、力量和措施出发,提出具备充分理论依据的法律构架,使法律所具有的规范性、确定性、可预期性、稳定性和普遍适用性等特点,与战略所要求的全局性、方向性、对抗性、预见性、谋略性和长期性等特点形成契合,将在一定程度上有助于增强海洋防务安全战略的合法性和正当性。Up till now,there is no State Marine Strategy for China,and it is rather incompatible with China's status as a state with vast oceanic territory(still not an oceanic power yet,though).To take efforts made to achieve rule of law and good governance at international plane as a background,there should be legal basis for all of the ocean-related activities undertaken by a state.Therefore it seems to be both necessary and imminent to offer explicit legal framework to support and safeguard the proposed strategy for marine defense in the future.Taking doctrines and practice by other states for reference,and judging from the purpose,principles,power and enforcement measures,a series of in-depth and specific doctrinal analysis are needed to construct further legal framework with solid doctrinal basis for the strategy in question.Furthermore,it is conducive to combine those characteristics of law such as normative,predictive,consistent and universally applicable,with the essential requirements of strategy,namely macro-scale,specifically directing,counteractive,stratagem,and stable in a long run,so as to enhance both legality and legitimacy of the strategy for marine defense.
