英国立法的公众咨询制度考察

摘　　要：英国在二十世纪八十年代建立了"规制影响分析"制度,在规制影响分析中引入了公众咨询制度,后在本世纪初则在立法过程中尤其是行政立法过程中确立了立法的公众咨询制度,通过颁布《咨询实务准则》确立了公众咨询的标准、程序与方法,具有很强的可操作性。英国立法的公众咨询制度在程序正当、方法多元性、意见回馈、结果评估等方面对我国法案公开征求意见制度具有一定的借鉴意义。The Great Briton established a system of ＂the analysis of regulation and its influence＂？ in the 1980s,into which public consultation system was introduced,and in the beginning of the 21st century,this system was then established in the process of legislation,especially in the process of the administrative legislation and through the promulgation of Consultative Practice Standard,Briton has established public consultative standards,procedures and methods,which are highly feasible.Public Consultative System in Briton＇s legislation may be a reference to Chinese system of soliciting public comments on proposed law in the aspects of due process,multi-methods,feedback and result assessment and so on.
