判决书“附带”:以中国基层司法“法官后语”实践为主线

摘　　要：判决书"附带",尤其是中国基层司法实践中的"法官后语",折射了关于判决书定义、功能,及法官角色和更宏大的司法的理论复杂,需深入辨析。而历史化地理解问题,并引入微观司法需求互动和宏观社会需求互动的概念,可深入洞察其关键,并获得关于判决书"附带"至司法等系列问题的"社会约定"的思考路径。由此推进,重视并积极回应被司法者和广泛司法关注者对司法的愿景,符合司法政治学的正当性理念,亦对中国现代正规司法建设有益。The appendix to a written judgment, especially a judge＇s supplementary comments, in the prac- tice of grass - root courts in China, refract a series of theoretical issues which may deserve further research, in particular the definition and function of the written judgment, the role of judge and the judicature, etc. Ob- serving from a historical perspective and introducing conceptions of both the micro - interaction of the need of judicature and the macro - interaction of the need of society may make it possible for us to see a crucial point as well as get a new way of speculation on the ＂social consensus＂ to the aforementioned appendix and the other issues of judicature. It will therefore benefit the construction of modem normal judicature in China.
