性犯罪的起源与婚姻家庭关系的变化

摘　　要：性犯罪是人类犯罪的一个重要类型。推动它起源的动力是人类进化中婚姻关系的变化。人类从动物界脱离出来处于原始状态时,过着群婚的生活,其范围起初是很广泛的,后来越来越小,直到最后仅留下今日所通行的一夫一妻的个体婚为止。在这一变化过程中,起初自然选择排除了群婚中的血缘关系,之后自营家庭经济又为满足私有财产和继承关系的需要而巩固了一夫一妻制家庭。但一夫一妻制从其一产生就违背了人类性爱自由的自然性,这使它对历史发展的进步作用和对人类性爱自由天性的束缚形成了二律背反的格局,导致了中世纪和资本主义社会的性犯罪虽然被禁止和严惩,但终不能被铲除的现象。然而,尽管如此,人类还是不断地采取各种各样的甚至奇特的方法,同性犯罪作斗争。Sexual crimes, one important type of crimes by human being, originated with the changes of marital relations in human evolution. At primitive stage when man differentiated from animals, they held communal mar- riage. The present monogamous marriage came into being after a long time evolution during which natural selection excluded marriage out of blood bond and the development of self - supporting family economy together with the de- velopment of private property and hereditary system further promoted the formation of monogamy. Whereas, monog- amy has been in contradictory with the naturalness of the freedom of human sex, which brings about the antinomy of its effects on human orom＇ess and it~ aan^trn;nc an th~ ~.f 1 C 1.
