表达权视域下的群体性事件治理

摘　　要：当代社会,表达权是一项基本人权,然而现实中公民表达自由的充分实现尚存在诸多制度限制和障碍,其结果是非制度化表达逐渐成为现阶段民众表达利益诉求的策略性选择,当前频发的群体性事件正是这种非制度化表达的极端表现。因此,正视群体性事件中民众的合理利益诉求,认可多元社会公民利益表达的正当性,并为之构建制度化的表达机制,或是一种妥善化解群体性事件的可行路径选择。In the contemporary society, the right to express is one of the basic human rights. However, in reality, there are many institutional constraints and barriers for citizens to fully get the right. Therefore, the non-institutionalized expression gradually become the strategic choice for citizens to demand their interests. The extreme expressions of the non-institutionalized expression is that there are more and more mass-incidents. Taking account of reasonable demands of citizens and constructing institutional expression mecha- nism is a viable choice to resolve mass-incident problems.
