摘　　要：我国刑事司法改革存在诸多误区及认识论和方法论谬误,必须及时加以检讨和纠正。改革既不能一蹴而就,也不能画地为牢;不能生搬硬套,更不能消极无为。而是坚持普遍经验与本国国情的有机结合,坚持有目的、分阶段、按步骤实施,通过从上而下和逐步推进的方式渐次展开。亦即,我国刑事司法改革应当坚持本土与域外制度的兼容与平衡从而匡正其价值取向。Chinese criminal justice reform has many erroneous zones and the epistemology and the methodology error,must prompt examine and the correction.The reform already cannot get it done in one action,also cannot the negative inactivity;Cannot copy mechanically and apply slavishly,cannot inhibit somebody＇s activities.But insisted that experiences and our country national condition organic synthesis generally,insisted that has the goal,to carry on by stages according to the step,through from,but under and advances gradually the way launches gradually.I.e.,our country criminal justice reform must insist the value orientation and the core principle lie in outside the native place and the territory system＇s compatibility and balanced.
