摘 要:食品损害惩罚性赔偿制度是《食品安全法》的重要创新,旨在发挥民事赔偿责任的惩罚、震慑和预防功能。但是该项制度在设计和法律适用上,还存在着请求权主体不明、连带责任的适用存疑、适用范围狭窄、惩罚性赔偿金规定不尽合理等诸多问题,需要进行相应的修改和完善,并根据不同食品损害赔偿纠纷的特点合理分配举证责任,构建与之配套的程序性保障机制,以切实提高该制度的实效性,妥善解决食品损害赔偿纠纷。Food damage punitive compensation system is an important innovation of Food Safety Law. It aims to improve the function of punishment, deterrent and prevention of civil liability for compensation. However the system has many disadvantages in its design and application,such as the claim subject is unknown, the application of joint liability is not clear, applicable range is narrow and punitive damage provisions are not rational, etc..All problems mentioned above should be corrected and perfected.At the same time, Legislators should establish several procedure safeguard systems according to the characteristics of different food damage compensation disputes and distribute burden of proof reasonably,so as to practically improve the effectiveness of this svstem and appropriately solve food damage compensation disputes.
