西部地区社会保障法制建设的必要性和可行性

摘　　要：社会保障在当今的经济和社会发展中具有十分积极的作用。而我国西部地区因其特殊的经济、政治、文化等各方面因素的影响,对社会保障以及相关法制建设的需要尤其突出。首先通过揭示我国西部地区社会保障的现状与问题,思考这一制约西部地区发展瓶颈的解决方法,不仅突显出社会保障在西部发展中不可替代的功能,更可以看作是西部地区社会保障法制建设具有必要性的缘由。在阐述问题解决的方法和西部地区社会法治建设的必要性之后,笔者就探讨建立和完善社会保障法制的具体途径以使问题的解决得到强有力的保障。本文从社会保障的宪法保护角度入手,探析建立中国特色社会主义社会保障法制建设的具体路径,包括基础性的法律制度完善、相配套的经济政策等外部支持,同时还积极探索新的路径,而这些都使西部地区社会保障法制建设的可行性更加坚定。Social security has a very positive role in the development of the modern economic and society.In China＇s western region,because of the special economic,political,cultural and other factors,the need to social security system and the relevant construction of legal system is especially prominent.At first,this article,by revealing the current situation and exist problems,explores the settlement about such bottleneck,which restricts the western region＇s development.It＇s not only to highlight the irreplaceable functions of the social security in the western region of China,but also can be treated as the reason of legislation.After explaining the way to solve the problems and the necessity of western region of China establishing the legal system of social security,the writer explores the specific ways to make the solution of those problems get strong protection.From the perspective of the constitutional protection,this article explores the specific paths of establishment of the legal construction of social security of socialism with Chinese characteristics,including the improvement of the basic legal system,the matching economic policy and other external support,but also actively explores the new paths.And these can make the feasibility of the construction of legal system of social security more decisive.
