我国防灾减灾法制建设的几点思考

摘　　要：我国是世界上自然灾害最严重的国家之一。在全球气候变化的背景下,自然灾害风险进一步凸显。面对各种灾害频发的威胁,加强我国防灾减灾法制建设是当务之急。目前我国已经修订并出台了《突发事件应对法》、《防震减灾法》等法律法规。但现有法律法规仍存在滞后性、可操作性不强等问题,防灾减灾法律制度仍需完善,通过比较和借鉴国外防灾减灾方面的法制建设经验,提出坚持以可持续发展观为指导,制定《灾害应对基本法》、《灾害救助法》等立法建议,并建立和健全国家自然灾害监测、预警系统及防灾减灾评估决策体系,健全防灾减灾资金监督保障机制,加强防灾减灾人才队伍培养和建设。China is a country which has the worst natural disasters in the word.In the background of global climate changes,the natural disaster risk is more and more obvious.Facing the various disasters threat,priority should be given to strengthening the construction of legal system of disaster prevention and reduction in our country.At present our country has been revised and introduced the response to emergencies act,the protecting against and mitigating earthquake disasters and other laws and regulations.But the existing laws and regulations have hysteresis,and operability is not strong.We should perfect the law system about disaster prevention and mitigation.Through the comparison and foreign disaster prevention and reduction of legal system construction experience,we put forward to the slogan about adhering to the guidance of sustainable development.At the same time,we should formulate the disaster to the basic law,the disaster relief law and so on and establish and improve the national disaster system which is about monitoring and warning system and assessment of disaster prevention and mitigation decision-making system.We should also improve the mechanism of funds in the disaster prevention and mitigation supervision mechanism,strengthen the disaster prevention and mitigation talents and construction.
