转型期南海城乡社区治理机制创新路径探索

摘　　要：转型期广东南海推行了以"政经分离"为核心的新一轮农村综合改革。在考量当前制约南海城乡社区稳定的基本因素后,提出了夯实基层民主法治基础、规范社区多元化治理机制的建议:完善城乡社区组织建设与基层民主法治保障;厘清城乡社区基本治理主体的地位及其职能;改善城乡社区党组织领导工作机制;理顺政府职责及其与社区的关系;确保社区治理与公共服务的保障力。为了消除影响南海城乡社区和谐稳定的痼疾,亟待推进以破解集体成员权保障难题为基点的配套制度改革:实行以经济社(原村民小组)为单位的成员权时点确权;依法界定享有成员权资格的成员类别及其权益保障范围;深化成员权和资产权相分离的股份制改革;继续推进"政经分离"后城乡社区治理结构配套改革。A new wave of comprehensive reformation featured by the separation between political administration and economic development has been carried out in Nanhai, Guangdong Province in the transitional period. After considering the main factors restricting the contemporary stability of urban and rural community in Nanhai,the paper proposed to enhance its legislation and construction of democratic system, regulate the multi-governance meehanism, improve its construction of basic organizations, clarify position and function of its subjects, improve its party organization leadership, figure out the relationship between duties of the government and the community,and guarantee the administration of communities and the relative public service. To solve the problems affecting stability, a system of reformation is re- quired to secure the right of group members; counterpoise the true point for each village group; legally define the qualification of the member and scope of rights and interests protection; deepen the stock re-form distinguishing the member right from ownership of assets; and continue to promote the system re-formation in terms of community governance structure after the＂political and economic separation＂.
