摘　　要：学校应对学生负有安全保护义务,学校与学生之间特殊的法定安全保护关系是这一义务的基础。该义务的内容包括适当管理之义务、正确引导义务、设施及场地的维护义务和警告义务。法院根据"理性人"标准认定学校是否违背了安全保护义务,学校的注意程度取决于学生的年龄、经验、心智成熟水平和事故发生的环境以及学生参与的活动种类。Schools should have protective duties to students.The special relationship of schools and students is base of these duties.The contents of these duties include 'to regulate appropriately,to guide properly,to maintain facilities and playgrounds,and to warn'.Courts should determine whether a school violates protective duties or not according to the test of 'rational person'.The degree of school's notice is determined by students′ age,experience,intelligence,environment and activities.
