摘　　要：本文通过对建设工程分包理论及相关法律、法规的分析，透过表层，探寻立法及判例投射出的工程分包体制的新动向，提出采用分判制作为建筑工程分包体制的改革方向。In this paper, through the analysis on construction subcontracting theory and related laws, seen from the appearance, legislation situation and the new tendency in construction subcontracting projected from the cases are explored, and the suggestion to adopt subletting system as the reform direction of construction subcontracting system is proposed.
