我国社区矫正制度主体模式的构建与完善

摘　　要：社区矫正制度主体是整个社区矫正工作的核心,明确社区矫正制度的主体将决定社区矫正工作的实效。《社区矫正实施办法》虽然对社区矫正制度的主体做了相关规定,但结合我国现实情况,社区矫正仍然存在着执行主体不明确、被执行主体不全面、社会力量参与度低等问题。通过完善立法,明确司法行政机关为社区矫正的执行机构,合理组建"1+1+X"矫正小组模式,鼓励社会力量积极参与,真正实现"在社区内矫正"罪犯。Community correction system is the core of community corrections as a whole, the explicitness of the subject of community correction system will determine the effectiveness of community corrections. Although The Implementing Meas- ures for Community Correction has made relevant stipulations towards the subject of community correction system, combined with our country＇s current situation, community correction still faces the problems such as uncertainty of implementing body, incompleteness of implemented body, low participation of social forces etc.. Through improving legislation, defining judicial administrative organ as the implementing institution of community correction, reasonably establishing ＂1 ＋ 1 ＋ X＂ correction group mode and encouraging active participation of social force, criminals ＂get corrected in community＂ would be truly accomplished.
