摘 要:农地制度是中国千百年来农村社会经济发展的基本制度支撑,而农地产权制度则是农地制度之核心。农村土地产权制度的安排、运行与变迁,无疑深深影响着国家经济社会发展与城镇化的推进。本文基于中国人民大学土地管理系与美国农村发展研究所(RDI)于2011年6-8月份进行的中国17省农村土地权利情况调查数据,从制度分析的视角出发,详细考察我国农地确权、农地流转、农地征收等具体情况,并在诺斯模型的基础上提出优化当前产权结构和产权运行的政策建议,以期通过农地产权的优化推动农村发展进程中"帕累托改进"的实现。Rural land system is the basic institutional support for the social and economic development in the rural areas of China for thousands of years, among which the rural land property rights institution is the core. The arrangement, operation and changes of rural land property rights institution deeply affect the national economic and social de- velopment, and also the urbanization. Based on the data collected by the 17-province ru- ral land rights survey in the year 2011, which was jointly organized by Renmin Universi- ty of China and Rural Development Institute of America, this paper analyzes the struc- ture and situation of China's rural land transfer, rural land expropriation, rural land fi- nance and other specific circumstances from the viewpoint of institutional analysis. It puts forward some suggestions to improve the structure and operation of rural land property rights on the basis of North Model, so as to provide reference to optimize the performance of the rural land property right to achieve Pareto improvement.
