摘　　要：非正规就业是吸纳劳动者就业的重要途径。现行劳动法未能对非正规就业予以相应的规制,导致非正规就业劳动者的权益被边缘化。要有效保障非正规就业劳动者的权益,须从以下几方面着手:1.完善就业权和报酬权以保障非正规就业者的生存权益;2.加强政府扶持,保障非正规就业劳动者的发展权益;3.完善社会保险制度和社会组织制度,实现非正规就业劳动者的社会权益。Special sector is an important approach to improvement of employment. The existing labor law fails to concern about the employment in special businesses, so the right and interests of the employees are marginalized. This article argues for the guarantee of the rights of the employees in such businesses, with governmental supports, and social security.
