摘　　要：司法审查人民调解协议制度的确立及运用是人民调解法制化发展进程中的重大举措,具有历史发展的必然性;是人民调解摆脱其发展瓶颈的制度设置,具有满足现实需要的客观性;是国家公权力、社会自治性权利和公民个体私权利和谐互动的重大体现和实现机制,具有鲜明的时代进步性;该制度契合法治与民主间的辩论关系,有利于促进二者的长足发展,求得双赢,具有完全的科学性;基于司法活动的本性,该制度的确立与运用可进一步充实人民调解的根基,具有十足的妥当性。The establishment and application of judicial review people＇s agreement system is an important measure in the developing progress of making people＇ s mediation lawful, with historical develo- ping inevitability. It is a new system making the people＇ s mediation unbound from its developing bottle- neck, with objectivity satisfying current practical demands. It is an important realization and practical mechanism among state public power, social automatic power and citizens＇ individual power which har- moniously interacted, with clear epoch-making progress. It is in line with dialectical relationship between law management and democracy, beneficial in promoting long-term development of the two so as to make a win-win situation, with complete scientificity. It is based on the nature of judicial activities. The establishment and application of the system will stabilize the foundation of people mediation with rich legitimacy.
