摘  要:基于历史考察和相关法律规定的规范分析以及当前社会发展现状研究,我国集体建设用地流转制度存在三方面问题:政府通过垄断土地一级市场而限制集体建设用地流转;立法保护不足导致农民应有土地权利缺失和利益受损;管理缺位造成违法用地严重和土地利用低效。通过集体建设用地使用权流转的应然分析和实证研究,我国集体建设用地使用权流转的完善应着眼于以下两个方面:第一,积极探索协调和整合土地整治、城乡统筹增减挂钩、集体建设用地流转三位一体的政策措施;第二,构建城乡统一的建设用地市场。According to the historical investigation, normative analysis on the corresponding laws and regulations and the study on the current social development, it can be found that three main issues exist in the transferring system of collective construction land in China:firstly, the government monopolize the primary market of land so as to constrain the transferring of collective construction land, secondly, legislative deficiency renders to the flaws of proper rights to use land and the loss of benefits to peasant, thirdly, the absent of necessary management leads to the illegal and inefficient use of land. The paper will focus on two possible approaches to consummate the system of collective construction land transfer in the way of both normative and empirical study. The one is to search the so-called trinity methods to coordinating three aspect's of policies and measures which are the comprehensive improvement of land, the mechanism of linking the increase and decrease of urban and rural construction land, and the transferring of collective construction land. And the other is to establish the integrated urban-rural market of construction land.
