摘　　要：长期以来,对罚金是否应当由附加刑上升为主刑,罚金在刑法分则中的设置范围应否扩大,未成年人犯罪能否适用罚金,以及罚金无法执行时能否易科自由刑,理论界一直存在重大争议。梳理各方观点,荟萃百家智慧,有助于我们做到兼听则明,更有助于正确发挥罚金在预防和惩治犯罪中的作用。For a long time,if fine penalty should rise to the principal by the additional penalty, if its setting scope in criminal law should be extended, if minor crime can be applied to fine penalty,and if the fine penalty cannot be executed can it easily free punishment,the significant controversy exist in the theoretical circle.To identify each point of view and recognize different wisdo- m enable us to correctly play the prevention and punishment function of fine penalty.
