试论中医药基本法名称的选择

摘　　要：为保障和促进我国中医药事业的发展,确定合适的法律名称对中医药基本法的制定至关重要。"中医药"一词自西方医学传入中国后出现,中医药包含汉族医药和少数民族医药,是我国古有的医学。选择中医药基本法名称时应考虑中医药相关法律政策的连续性、国际交流2方面因素。在上述分析的基础上认为,"中华人民共和国中医药法"这一名称较为符合当前中医药立法实践。It is very important to confirm the appropriate legal name for the basic law on Chinese Medicine to promote the development of chinese Msdicine. This article dwells on that how we should select the basic law name on Chinese Medicine from the origin of the word ＂Chinese Medicine＂, the connotation and extension of Chinese Medicine, the factor considered when choosing the basic law name of Chinese Medicine, etc. On the basis of the analysis in the above, we consider that the name ＂Chinese Medicine law of the People＇s Republic＂ is more accord with current legislation practice of Chinese medicine.
