“信息封建主义”说的主要贡献、不足与完善——与彼得·达沃豪斯及约翰·布雷斯韦特教授商榷

摘　　要："信息封建主义"说揭露了《TRIPS协议》出台的真相,抨击了它的不平等性和弊害,还提出了一些改革方案,如民主化产权等。但是,"信息封建主义"说也存在一些不足,如有的改革方案相互存在抵触、有的改革方案不具体等。对"信息封建主义"说的完善,主要应按照民主化产权程序,对现行知识产权制度进行"一收""一扩":"一收"即将知识私权的权利边界进行适当收缩和限制,扩大和加强公共领域保护;"一扩"即把发展中国家占优势的传统资源剥离出公共领域,纳入知识私权范畴。The Theory of Information Feudalism has exposed the truth of the introduction of TRIPS agreement,attacked its non-equality and harm,provided some reform schemes,such as democratization of property rights and so on.But there are some shorts in the Theory of Information Feudalism such as some reform schemes are in fact conflicts with each other,some reform schemes are not concrete etc..On the improvement of the Theory of Information Feudalism,we should contract the scope of intellectual property in the existing law,enlarge and strengthen the protection of the public domain on one hand,and peel the traditional resources from the public domain and put it into the IP on the other hand.
