摘 要:农村违法建筑征收补偿问题是近年来征收实务中的热点和难题。征收城市违法建筑"一律不补"的规定不能适用于农村违法建筑。从现实角度看,农村违法建筑类型多样、成因复杂,对其征收补偿关系到社会的稳定与和谐。从立法和司法角度看,海内外相关立法和司法实践支持对征收农村违法建筑进行适当补偿。立法应区分不同类型的农村违法建筑,按照"衡平补偿原则"具体设计农村违法建筑征收补偿制度,实现"对物补偿"到"对人补偿"理念的转变。The compensation for rural illegal buildings is the hot spot of collection practice and also where the difficulty lies. The rule of "no compensation on urban illegal buildings" is not appropriate for rural illegal buildings. Rural illegal buildings vary in building types and are built because of different reasons. Thus, the compensation for rural illegal buildings is tightly related with social stability and social harmony. From the legislative and judicial aspect, the relative leg- islative and judicial practice both home and abroad back up the compensation for rural illegal buildings. Legislative principle should distinguish different types of rural illegal buildings and de- sign the compensation rules based on the principle of equity compensation and therefore transferfrom the compensation for things to the compensation for men.
