行政指导在公益征收中的现状及完善研究

摘　　要：在土地、房屋等不动产公益征收领域,以征拆口号为典型标志的行政指导行为也无处不在。作为行政指导和政策实施的一种具体方式,目前征拆口号整体处于失效模式。对于公益征收领域中普遍存在的口号现象的治理,应采取"两分法"策略:一方面,通过政府自身约束,规范行政程序,完善行政复议制度,限制行政执法人员言行,进行征拆口号本身的制度化建设;另一方面,引入适度的司法审查进行外力干预,赋予法院对损害行政相对人权益的具体行政行为的司法审查权。从而使这类行为在自主性与开放性、合法性与合理性、感性与理性之间达致某种程度的均衡。In the land, housing and other real estate levy for public interest areas, the administrative guidance featured by the slogans for land requisition and demolishing exists everywhere. As a concrete means of administrative guidance and policy implementation, the slogan for land requisition and demolishing fails completely. For the prevalent slogan treatment in public welfare levy, the government should adopt a ＂dichotomy＂ strategy： on the one hand, through the government＇s own constraints, standardizing administrative procedures, improving the system of administrative reconsideration, administrative law enforcement personnel and restrictions, strengthening the institutional construction of slogans for land requisition and demolishing; on the other＇hand, introducing the external intervention of the judicial review, endowing the court with the right of judicial review for damaging the rights and interests of the administrative relative person. Thus, a certain degree of balance of this kind of behavior can be reached between the autonomy and openness, legitimacy and rationality, emotion and reason.
