BOT模式软化下无居民海岛开发的实证分析

摘　　要：无居民海岛开发与管理采用建设—经营—移交(BOT)模式,不但丰富和发展了BOT的理论与实践,而且促进了无居民海岛开发与管理的多元化和灵活化。马尔代夫无居民海岛开发的实践表明,通过在投资主体、投资领域、内资介入等若干不同进路来实现BOT模式是可行的。基于无居民海岛的自然属性、社会属性以及法律属性的认知,我国无居民海岛BOT模式软化视野下的融资法律机制,是BOT模式软化趋势的理论和实践创新。本文通过融资契约模型的解读,提出BOT模式软化下的融资机制——构建政府补贴和保证金的有机融合模式。BOT Mode is a mode of development and management of Uninhahitated Islands. It not only enriches and develop the theory and practice of the BOT Mode, but also promote the diversity and flexibility of the development and management of the Uninhabitated Islands. The reality of the development of Maldive＇ s Uninhabitated Islands shows that it is feasible to realize the BOT Mode through myriad of approaches, such as main body of investment, habitated Islanders＇ areas of investment, domestic capital involvement etc. In view of the identification of Uninnatural attributes, social attributes and legal attributes, the mechanism of the law of amalgamation of capital, under the vision of softening BOT Mode of China＇ s Uninhabitated Islanders＇ is an innovation of the theory and practice of the trend of softening mation mechanism -namely to construct an organic of BOT Mode. This paper tries to propose a capital Amalga amalgamation mode with government -provided stipend and guaranteed fund through a reading of the ＂Capital amalgamation Mode＂ type.
