摘 要:涉诉信访是当前司法工作压力的重要来源。现行的司法与政治制度、公众对司法的不信任危机,以及当事人与法官对司法过程的不同期待等多方面因素共同促成了涉诉信访的高发状态;对此,实践中通常会采取领导干部接访、经济补偿等多种平息措施。但信访是实现公民权利的一种行政途径和方法,以信访监督司法,不仅不能真正解决问题,还可能使本就权威不足的司法进一步丧失坚守法治底限的能力。The litigation-related complaints should be an important source of stress in the judicial procedure. The causes of the alarming frequency of the litigation-related complaints are a complex blend, which includes the problems of institutions of justice and politics, the public having no faith in the justice, the judge and the other persons concerned having different expectations, and so on. A number of measures are made to solve the problem, for example, making an interview with leaders or giving them some money, etc. However, as an administrative way to realize civil rights, complaints can not be used to supervise the justice, or it would damage the authority of justice even to break the deadline of rule of law instead of solving problems thoroughly.
