摘 要:我国现行著作权法仅规定了视听作品首次使用的付酬问题,而未明确规定视听作品二次使用的付酬问题。最新公布的著作权法修改草案引入了视听作品二次使用的付酬制度。该制度有利于保护原作作者、编剧、导演、作词、作曲作者及表演者的利益,但不利于保护制片人的利益,对电影产业的发展会产生一些消极影响。我国著作权法在引入视听作品二次使用付酬制度时应当慎重考虑。对于原作作者、编剧、导演、作词、作曲作者及表演者要求分享报酬的要求,可以由当事人通过协议解决。协商不成,由法院审理决定。The current China Copyright Law only provides the rules about compensation of audio-video works" first use, but it doesn't clarify the question about compensation of audio-video works' second use. The latest published draft of Copyright Law Amendments adopted the compensating system of audio- video works' second use. This compensation system will benefit the drama authors, screenwriters, direc- tors, lyricists, composers and actors, but bear disadvantages to protect the film producers" benefits, which will cause certain negative effects on the development of this industry. So, we should seriously consider the issue about compensating system of audio-video works" second use when introducing it into the Copyright Law. Regarding to the requirements of sharing compensation by drama authors, screen- writers, directors, lyricists, composers and actors, it can be resolved through contract signed by two parties. In case of failing to reach an agreement, the dispute between two parties shall be heard by the court.
