法人治理结构改革中的政事关系:从官僚层级关系到交易关系  

The Relations between Government and Public Institutions during Reforms towards a Legal Entity-based Governance Structure: from direct bureaucratic administration to a transactional relationship

摘　　要：深圳市在统一机关津贴和改革事业单位人事制度后,政府在事业单位的部门利益空间已被压缩并逐步消解,政事间的官僚层级关系开始松动。此时推进的事业单位法人治理结构改革呈现出政府与相关事业单位达成交易关系的过程,作为政事交易关系中的妥协结果,通过建立法人治理结构,以理事会的成立与运作使政府适当下放经营决策权,事业单位适度享有经营自主权。这一过程体现了政事关系从官僚层级关系到交易关系的过渡。After the City of Shenzhen unified government stipend and revamped the personnel system of public-financed institutions, government＇s sectorial interests in public institutions have been reduced and are gradually dissolving. The direct bureaucratic control that formerly informed government-public institution relationship has been loosened and is giving way to a more contractual transaction-based relationship, with the public institutions increasingly assuming a role of independent legal entity. This change is marked by increased administrative autonomy for the institutions and strengthened authority for their boards of trustees, switching the relationship between government and public institutions from one of direct bureaucractic administration to that of contractual transaction.
