摘　　要：随着经济全球化与专利活动国际化的发展,通过专利合作条约制度和地区专利制度而形成的同族专利越来越多。在辨析了有代表性的两种同族专利定义之后,认为在当前现实下,同族专利应当是主要指根据同一发明创造,在多个国家或者地区进行的专利申请或者专利授权而形成的专利组合。,往往以优先权申请、PCT申请、地区专利申请为基础。进而分析了综合利用各类国际专利制度取得专利族的多种途径、策略及这些专利族的基础和结构。With file development of globalization of economy and the internationalization of patenting activity, the number of patent fami- lies formed through the Patent Cooperation Treaty（ PCT ） system and the regional patent system is increasing. After discriminating the two typical traditional definitions of patent family, this paper proposes that it should mainly refer to patent portfolio of patent applications or grants relating to the same invention in multiple countries or regions, which is often based on the ＂priority／PC-q＇／ regional＂ patent applica- tions. This paper analyzes the ways and strategies to obtain patent family by comprehensive utilization oi＇ various international patent sys- tems. The basis and structure of these patent families are also analyzed.
