摘 要:2005年以后政府出台若干政策承认民间借贷具有制度层面的合法性。但不容乐观的是,现有民间借贷制度规范中仍存在诸多压制性的内容,民间借贷的法律体系也存在立法层次低、前后矛盾、缺乏协调性等问题,相关配套制度也处于缺位状态。应深化金融体制改革和进行制度创新,逐渐消除对于民间借贷的抑制性规定,同时建立健全民间借贷法律体系及有关配套制度,以实现民间借贷监管的规范化和法制化。With the advancement of China's financial reform, the important role of private credit and the significance of its legalization have been emphasized by governmental policy-making department. Since 2005, the government has introduced a number of policies to intensify the legitimacy of private lending on institutional level. But what is not optimistic is that there are still many oppressive oontents existing in the cun'ent private lending system. The legal system of private lending also has many demerits such as legislation flaws, inconsistencies, lack of coordination and so on. Besides, some related supporting systems are in a state of absence. The reform of the financial system and system innovation should be deepened and some inhibitory provisions for private lending should be gradually eliminated. At the same time, the legal system of private lending and relevant supporting systems have to be established and perfected so as to realize standardization and legalization of private lending regulation.
