论我国缺失家庭现状与《社会救助法》的完善

摘　　要：缺失家庭是指因意外事件导致家庭成员死亡或严重伤残,原有家庭结构发生变化,家庭严重残缺,家庭功能及家庭成员生活受到严重影响的家庭。缺失家庭是我国在经济社会发展过程中遇到的新问题,在社会救助法中明确规定对缺失家庭的救助,与我国宪法的立法精神相一致,是国家和社会对于公民生活现状关注的具体体现。从我国社会现实问题出发,提出一些对于缺失家庭法律救助制度的初步设想,希望对缺失家庭社会救助法律制度的建立有所贡献。The absence of family is due to accidents resulting in death or serious disability of family members, the original family structure being changed, family being incomplete, family functioning and family members＇ living being severely affected. The absence of family is our new problems encountered in the process of economic and social development. The assistance for the absence of family has been defined clearly in Social Assistance Act, being consistent with the spirit of the legislation of our Constitution, which is the concrete manifestation of the national and social concern for the status of civic life. From the issues of China＇s social reality, the author puts forward some initial ideas for the absence of family legal aid system, hoping to contribute to the establishment of the social legal aid system for the absence of family.
