摘　　要：环境资源产权制度是界定、配置、行使和保护环境资源产权的一系列规则,主要包括:一是环境资源产权界定和配置制度,包括环境资源所有权、环境资源使用权、环境资源收益权三种权利归谁所有、如何分配以及具体的执行方式;二是环境资源产权交易制度,包括环境资源使用权交易的设置原则和主要内容;三是环境资源产权保护制度,包括环境资源所有权、使用权和收益权三个层面的保护制度。Environmental resource property right system is a series of rules of defined, configured, exercised and protected environment resource property fights. It mainly includes the follows. The first is the environmental resource property right definition and configure system, including environmental resources ownership, environmental resources use right and environmental resources usufruct which how to allocate and specific implementation methods. The second is the environmental resource property right transaction system, including environmental resources use right transaction set principle and main content. The third is the environmental resource property right protection system, including three level protection system of environment resource ownership, use right and the right to return.
