德法兼治对实现我国社会公正的价值研究文献综述

摘　　要：公平正义是人类社会追求的永恒价值信念，是人类不懈追求的理想，也是我们构建社会主义和谐社会的价值取向。本文试图对现有的公平正义理论加以梳理和研究，探讨公平正义的价值标准；其次通过对德治与法治两种治理方式的理论基础和优势、缺陷进行比较研究，论证德法兼治对促进和实现社会公平正义的的可行性和必要性。Fairness and justice is the eternal value pursued byhumansociety; it is the ideal un- remittingly pursued by human; it is also the value orientation for us to construct harmonious soci-ety. This article tries to analyze the present fairness and justice theory, and discuss its value standard. By comparatively research the theory foundations, advantages and disadvantages of rule of virtueandrule of law, it demonstrates that it is feasible andnecessarytopromoteandrealize social fairness andjusticebyrulingofvirtueandlaw.
