摘　　要：役权是传统大陆法系物权法上的一项重要制度,在英美财产法上也占有重要地位。遗憾的是,学界对英美财产法上的役权制度没有给予应有的关注,因此亟须进行深入研究。在美国,作为私益限制的役权变得越来越重要,主要分为三类,即地役权、不动产契据权和衡平地役权。《美国财产法第三次重述:役权》就是英美财产法上役权制度的集中规定和体现。《美国财产法第三次重述:役权》对传统役权制度的各个方面进行了简化和明晰化,其规定体现了役权的发展趋势。相关的具体制度设计对我国不无借鉴意义。Iservitude is an important property right in civil law family. It＇s a pity that we scholars don＇t pay enough attention to the servitude. The servitude, as a limitation on private interest, be- comes more important in American law. The servitude can be divided three types： easement, real con- venient and Profit. As the main part of the servitude law, Restatement of the Law, Third, Property （Servitudes） simplifies and clarifies the traditional servitudes. Some rules of Restatement of the Law, Third, Property （Servitudes） embody the tendency of servitudes, and can be a source of reference to our country legislation.
