摘　　要：制定《公众意见征询法》有利于保障公民政治参与的有效性,促进公民政治参与权利的实现,并有利于提高立法和公共决策的正当性。在我国,制定《公众意见征询法》既有政策和法律基础,又具有理论和实践基础,但该法的制定也面临着一些障碍。决策者需要在充分认知其重要性的基础上克服理念和机制等层面的问题,为该法的制定创造现实的条件。《公众意见征询法》应建立与征询相关的信息公开制度,并对征询公众意见的条件、征询方式、公众意见的反馈以及公众权利的保障等内容作出明确规定。The promulgation of the Law on Public Consultation is conducive to guaranteeing the effectiveness of citizens＇ political participation and involvement, facilitating the actualization of citizens＇ rights to political participation, and promoting the legitimacy of legislation and public decision making. As for China, not only does the enactment of the Law on Public Consultation have policy and legal bases but also it is endowed with the necessary theo- retical and practical foundations; however, its enforcement in China still encounters a number of obstacles. Deci- sion - makers should, on the basis of fully bewaring of the significance of the Law on Public Consultation, exert their utmost to overcome all the problems either conceptually or institutionally, and to create favorable conditions for its actualization. The Law on Public Consultation should formulate an information disclosure system relating to public consultation and clearly stipulate such key issues as the conditions of public consultation, the means of consulting public opinions, the feedback of public opinions, and the assurance of public rights.
