宪政视野下我国控权模式的思考

摘　　要：对比美国为代表的资本主义国家宪政发展,就控权模式而言,我国的"监督制约"模式与"三权分立"模式各有利弊,如何完善我国的控权模式,是我国宪政发展的关键。从完善我国权力运行模式的角度出发,提出加强和完善人大代表罢免制度与人大代表对人大常委委员的罢免制度,使国家权力在运行至公民权利的边界时,通过选民对人大代表与人大代表对人大常委委员的监督压力,而将其转化为权利对权力的压力,进而使权力在封闭的环状轨道内运行,在不改变我国现行政治体制的情况下完善我国的控权模式的建议。In contrast to the United States on behalf of the capitalist state constitutional development,on the power control mode,the ＂supervision＂ mode and the ＂separation of the three powers＂ models have their advantages and disadvantages.How to perfect our country s power control mode,is the key to the development of constitutional government in china.This article from the perfection of power operation mode angle,put forward to strengthen and improve the NPC deputies recall system and establishment of National People＇s Congress Standing Committee members of the recall system,so that state power in the run up to the boundary of civil rights,the National People＇s Congress by voters and deputies to the national people＇s Congress Standing Committee members of the supervisory pressure,and convert them to right to power pressure,so that the power in a closed annular track running,without changing the present political system under the condition of perfect our power control mode.
