摘　　要：文章通过比较研究,从产权分配、土地市场、征地制度和农地保护四个方面分析了中美两国农地制度的差异。讨论的结果发现,不同的产权分配会对农地制度的其他三个方面产生重要的影响。文章认为,进一步的农地制度改革首先应从农地的产权分配做起,而且土地制度改革的主要动力来自于纠正农地征收和农地保护中的矛盾,而不在于提高农地交易市场的效率。In this paper we compare farmland institutions in China and USA from the perspectives of land property rights distribution, land market, land acquisition and farmland protection. We find that land property rights distribution has significant implications for the other three issues, and the impetus for further farmland institutional reform should come from resolving the contradiction between land acquisition and farmland protection, and not from incentives to improve transaction efficiency of land market.
