英国警察对聚众活动的治安执法及法律之演进研究

摘　　要：英美模式与欧陆模式警察机制中的治安执法所依据的法律制度与实践已逐渐呈融合之势,某些核心价值和执法程序已成为各方不可或缺的必然之选。因更为适合当今法治的预期与实效,英国警制的一些重要核心价值得到了两种模式的共同认可。作为普通法国家,英国处置聚众活动的警察制度包含了制定法和判例以及警察机制的执法裁量;加之立法、行政和司法监督机制共同构成了警察处置聚众活动的治安权行使过程。在英国特有的公法传统影响下,警察处置聚众活动的治安权法律体系和执法程序围绕其特有的原则和价值核心呈现波动型变化;警察执法中体现出的比例原则和公法契约思想已得到了广泛认可和应用,这不仅符合宪政主义的法理,同时也符合行政执法的效能要求。The British police legal system （Anglo- American police system） and the European continental police legal system and their respective enforcement practices regarding policing protests and other mass activities are becoming ever - more similar, and some core values and law enforcement procedures of the British police legal system have become essential elements in both police legal systems. The UK is a common law country, and its legal system for policing mass activities contains statute laws, case laws and discretionary police practices, as well the laws pertaining to systems of legislative, administrative and judicial powers. The forming of the UK＇s legal system in this respect is a fluctuating dynamic process around statute laws and law principles established under the influence of the UK＇s special public law traditions. The principle of proportionality and law of contract theory have been widely recognized, and they not only meet the demand of juridical logic of constitutionality, but also the demand of administrative law enforcement efficiency.
