摘　　要：所有权保留的法律性质 ,以“附停止条件所有权转移说”更为可取。在我国 ,保留所有权买卖既适用于动产 ,也适用于不动产 ,而其登记可采分别主义和对抗主义 ,内容应尽可能简明。The “doctrine of ownership transfer with conditions for suspension” is a better explanation of the legal nature of ownership reservation.In our country,ownership reservation purchase applies both to movable property and real estate.As for its registration,either the test of differentiation or adverse may be adopted,and matters for registration should be as explicit as possible.
