摘　　要：针对铁路货运事故责任认定中出现的理解"铁路运输过程中"含义、定责意见分歧、承托双方责任界限不明、定责依据不足等问题,以及货运事故的责任划分中出现的划分原则理解、执行标准、常见的责任划分争议等问题,提出解决问题方法的思考,即正确理解规章及标准,明确责任限界,依靠设备提供定责依据,落实和完善制度与责任。Targeting with understanding the 'during railway transport process' meaning arisen in responsibility opinion of railway freight transport accident and the problems existing in divarication of the responsibility opinion, undefined ambit between carrier and shipper and deficiency of responsibility cognizance gist, as well as the problems existing in compartmentalization principle understanding, implement standard and the familiar compartmentalization disputation. The paper also puts forward the ideas of solving the problems, such as exactly understanding the regulations and standards, clearing the responsibility ambit, providing responsibility cognizance depending on relative equipments and fulfilling and improving system and responsibility.
