摘　　要：创造性检索是判断专利申请是否具备创造性以及预测授权前景的参考依据,本文基于对《专利法》和《专利审查指南》有关创造性判断原则和基准的理解,以机械类专利查新为例,探讨了对比文献为同领域现有技术、不同领域现有技术时创造性的判断方法,以及发明的用途及预期效果对创造性判断的影响。Patent novelty creative judgment is widely used in patent application and infringement litigation. This paper, based on the understanding of the creative judgment rules of 《patent law》 and 《patent examination guidelines》, selected the mechanical patent novelty as the example, discussed the method of novelty creative judgment of the comparative documents in which the existing technology was in the same field, and the comparative documents in which the existing technology was in the different field, as well as the purpose and intended effect of the invention creative judgment.
