摘　　要：侵权法是私权保护的主要方式,其价值理论基础为矫正正义。传统矫正正义观确立了"无害于人"的消极行为标准,导致了人与人之间的冷漠,铸就了侵权行为的道德根基。矫正正义应作为一种独立的正义形式,而非囿于过错被视为分配正义之延续。现代社会转型为风险社会,利益诉求多元化,权利意识觉醒,私权保护成为时代议题,但囿于私法传统与理念的长期缺位,私法秩序并非井然,加之司法腐败与职业道德缺失,私权难以周延保障。矫正正义观现代转向应契合私法理念,偏重安全价值,凸显人文关怀,追求实质正义。私权保护应积极发挥矫正正义作用,以人为本,物质性权利和精神性权利保护并重,注重对弱势群体的保护,从资源配置维度关心人的生活状态和质量变化,建立多元化综合救济体制,营造和谐人际关系,促进人的自由发展。Tort law is the main way of private rights protection, whose value theoretical basis is the corrective justice. Traditional corrective justice system ignores the behavior standard of ＂no harm to people＂, leading to apathy among peo ple, which makes the moral foundation of tort. As a kind of independent justice form, corrective justice should not only be regarded as a continuation of distributive justice. The modem society transforms to a risk society, the diversification of interests, rights awareness and private rights protection become contemporary issues, but due to the long term absence of private law tradition and the concept, the private law order is not in place, and because of judicial corruption and oc cupation moral deficiency, private rights is difficult to comprehensively safeguard. Modem steering of corrective justice view must conform to the idea of private law, emphasize the security value, highlight humanistic concern, and pursuit substantive justice. The protection of private rights should take the principle of people oriented, both concern the pro tection on the materiality rights and spiritual rights, care about the status and quality of people lives change dimension from the allocation of resources, establish a diversified relief system, to create a harmonious interpersonal relationship, and promote the free development of human, i
