摘　　要：没收财产刑是我国重要的刑罚之一,但在其适用上仍存在很大的争议。是否适用没收财产刑,如何准确适用没收财产刑是需要我们考虑的重要问题。明确适用没收财产刑的裁量原则是准确适用这一刑罚的前提条件。没收财产刑的一般性原则和特有原则共同组成了没收财产刑裁量原则的整体。Confiscation of property is an important penalty in China, but its application is still in controversy. The applicability of confiscation of property, and its accurate application are important issues. Define the discretionary principle of confiscation of property is the prerequisite of accurate application of this penalty. The general principle and peculiar principle comprise the discretionary principle of confiscation of property.
