论警察临战用枪中的“判明”

摘　　要：判明情况是警察临战用枪的首要前提。所谓"判明",就是在某种具体的执法情境中,临战警察根据自身对相关法律法规的理解,对现场情形应否使用枪支、何时使用枪支以及如何使用枪支做出的判断。正确理解"判明"需要解决"判明"应遵循的原则、评判"判明"的标准和警察临战"判明"错误是否应承担责任等几个问题。目前应从完善相关法律法规完训练机制等方面提高警察"判明"能力。The judgment onsituation is the prerequisite for a police in emergency with guns. The so- called ＂Judgment ＂means when a police is in emergency in the specific law enforcement, he must determines whether he may use gun or when and how to use gun according to the related laws and regulations. Correct ＂ judgment＂ can be made with better understanding of principles, evaluation standards and responsibilities for error ＂judgment＂. At present, we should improve the related laws, regulations and training mechanism so as to improve the police ＂judgment＂ abilities.
