征地制度的来龙去脉及其变革路径找寻

摘　　要：党的十八大提出"改革征地制度,提高农民在土地增值收益中的分配比例"的改革取向。征地制度改革必须以科学发展观为导向,进行科学的顶层设计,统筹兼顾各方利益,配套相应制度安排,稳步稳妥地逐步推进。尤其是,应该将现行的征地制度一分为二:因公共利益用地的"土地征用"和因经营性用地的"土地征收",逐步放开经营性用地项目的股份制开发经营,让农民直接分享土地增值收益。同时,还应规范农地变市地过程中农村集体经济组织与农民的合理分享比例。The party＇s eighteen is proposed to reform the system, raising farmers＇ income in land value increment the allocation proportion of the reform orientation. The land requisition system reform must take the scientific concept of development as the guidance, the top of the scientific design, overall consideration the interests of both sides, and form a complete set of corresponding system arrangement, steady and steadily advance step by step. In particular, should be the current land requisition system is split in two： for public interest for land ＂land requisition＂ and because of profit-oriented land ＂land levy＂; Gradually let go of profit-oriented project development and management of stock, to let farmers direct share land value-added income. At the same time, should also be standard ShiDe farmland change in the process of rural collective economic organizations and farmers＇ reasonable share proportion.
