摘 要:随着中国民用航空器跨国租赁市场的繁荣,民用航空器跨国留置纠纷频发。由于对留置权成立要件存在不同理解,在个案处理中争议颇多。从美国对类似民用航空器留置案处理的经验及其留置规则来看,中国应从民用航空器跨国租赁的实践需要出发,应已加入的国际航空器权利公约的要求,采纳民用航空器留置权与民用航空器优先权并存的担保模式,明晰留置权成立要件,填补民用航空器留置权空白,构建科学合理的民用航空器留置体系。The booming of the transnational aircraft leasing market has brought about more aircraft lien disputes. Due to different understanding on the elements of the establishment of lien, it has triggered controversy in such disputes. From experiences of the US in similar cases and its lien rules, and conforming to the requirement of practices in the transnational civil aircraft leasing and the convention that we have joined, we should adopt the coexistence model of civil aircraft lien and civil aircraft priority right and clarify the establishment elements of liens and fill the gap of the civil aircraft lien. After that we can construct a scientific and reasonable system of civil aircraft lien in our country.
