环保法视角下中国商品住宅不合理空置的治理

摘　　要：中国商品住宅的空置现象存在严重的不合理性,其中隐藏的资源浪费和环境破坏问题没有受到应有的重视。从可持续发展、生态文明、资源的社会性等环保法理念出发,对不合理空置现象进行了评述分析,提出立法建议,希望借助环境和自然资源保护法的力量,从根源上治理中国商品住宅不合理空置问题。Housing vacancy rate in China gradually manifests irrationality which attracts great attention, but the waste of resources and environmental problems implied in that has been seriously neglected. Therefore, the paper tries to an- alyse the ideological roots of the problem in the framework of environmental protection law , mainly on the basic of the Sustainable Development Concept,the Ecosystem Civilization Principle, and the social nature of resourses. Aiming at radically dealing with the unreasonable housing vacancy rate in China with the rule of law, some legislative proposals on legislation are raised finally.
